1. Agreement to Terms

By accessing or using the website located at shieldhome.pro (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Site. ShieldHome Pro ("we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.

2. About ShieldHome Pro & Dealer Relationship

ShieldHome Pro is an independently owned and operated authorized dealer of Vivint Smart Home products and services. We are not Vivint Smart Home, Inc. and we do not represent ourselves as Vivint or any subsidiary or affiliate of Vivint.

Our role is to connect prospective customers with Vivint Smart Home by collecting contact and home information through our Site and forwarding that information to Vivint for follow-up, consultation, and service fulfillment. All product installation, monitoring services, warranties, and service agreements are provided directly by Vivint Smart Home, Inc. and are subject to Vivint's own terms and conditions.

Vivint® is a registered trademark of Vivint Smart Home, Inc. All trademarks, logos, and brand names referenced on this Site are the property of their respective owners.

3. Lead Generation & Consent to Contact

The primary purpose of this Site is lead generation. When you submit your information through any form on the Site, you understand and agree that:

• Your information (including name, phone number, email, and home details) will be shared with Vivint Smart Home, Inc. and potentially other service partners for the purpose of contacting you about home security products and services.
• You consent to being contacted by ShieldHome Pro and/or Vivint Smart Home by phone (including autodialed and prerecorded calls), text message (SMS/MMS), and email at the contact information you provide, even if your number is on a do-not-call list.
• Your consent is not a condition of purchase. You may revoke consent at any time by contacting us at support@shieldhome.pro or replying STOP to any text message.
• Standard message and data rates may apply to text messages.

4. No Guarantee of Service or Pricing

All information presented on the Site, including pricing, promotions, product descriptions, and service availability, is provided for informational purposes only and is subject to change without notice. We do not guarantee:

• That any specific product, service, or promotion will be available in your area.
• That pricing shown on the Site will be the final price offered to you by Vivint.
• That any particular equipment package, feature, or installation timeline will be available.
• That the information on the Site is complete, accurate, or up to date at all times.

Final pricing, product availability, service terms, and contract details are determined solely by Vivint Smart Home, Inc. at the time of your consultation and agreement.

5. Acceptable Use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information.
• Interfere with or disrupt the Site's operation, servers, or connected networks.
• Attempt to gain unauthorized access to any part of the Site or its systems.

• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

TO THE FULLEST EXTENT PERMITTED BY LAW, SHIELDHOME PRO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHIELDHOME PRO, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for all claims arising out of or relating to the Site or these Terms shall not exceed one hundred dollars ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless ShieldHome Pro, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts.

For any disputes, you agree to first attempt to resolve the matter informally by contacting us at support@shieldhome.pro. If a dispute cannot be resolved informally within 30 days, either party may proceed with formal legal action.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShieldHome Pro regarding your use of the Site and supersede all prior agreements, understandings, and communications, whether written or oral.
